Terms of Service

1. Acceptance of Terms

By scheduling, authorising, or receiving any service from PrimeCraft Auto ("Company", "we", "us", or "our"), you ("Customer", "Client", or "you") agree to be bound by these Terms of Service ("Terms") in their entirety. If you do not agree with any part of these Terms, you must not use our services. These Terms constitute a legally binding agreement between you and PrimeCraft Auto.

2. Scope of Services

PrimeCraft Auto provides automotive detailing, mechanical repair, bodywork, and mobile service. Each service is limited strictly to the specific work described in the work order or booking confirmation. Completion of one repair or service does not imply inspection, warranty, or responsibility for any other component, system, or part of the vehicle not explicitly listed in the work order.

For example: performing a brake service does not constitute an inspection of the engine, transmission, suspension, electrical systems, or any other vehicle component. The Customer is solely responsible for ensuring the overall roadworthiness of their vehicle beyond the specific service performed.

3. Warranty & Guarantee Policy

PrimeCraft Auto provides limited warranties on completed work as described in the table below. All warranty claims must be submitted in writing to [email protected] within the applicable warranty period. Warranty coverage applies only to defects in workmanship directly attributable to the specific service performed and does not extend to normal wear and tear, subsequent damage, or pre-existing conditions.

Warranty is void if the vehicle has been modified, repaired, or serviced by a third party after our service, or if the Customer has failed to follow recommended maintenance schedules.

4. Limitation of Liability

THIS IS A CRITICAL SECTION. PLEASE READ CAREFULLY.

PrimeCraft Auto's liability is strictly limited to the cost of the specific service performed as stated on the invoice. Under no circumstances shall PrimeCraft Auto be liable for:

  • (1)Damage to, failure of, or defects in any vehicle component, system, or part not explicitly covered by the work order, regardless of when such damage or failure occurs.
  • (2)Consequential, incidental, indirect, special, or punitive damages of any kind, including but not limited to loss of use of the vehicle, rental car costs, towing costs, lost income, or personal injury arising from vehicle failure.
  • (3)Pre-existing conditions, latent defects, or vehicle issues that were present prior to service, even if undiscovered at the time of service.
  • (4)Failures or damage caused by normal wear and tear, manufacturer defects, improper use, accidents, or environmental factors.
  • (5)Any claim arising more than ninety (90) days after the date of service, regardless of when the alleged defect was discovered.
  • (6)Damage resulting from the Customer's failure to maintain the vehicle in accordance with manufacturer recommendations.
  • (7)Loss or damage to personal property left in the vehicle during service.

By way of example and not limitation: if PrimeCraft Auto performs a brake service on your vehicle and, at any later date, your engine, transmission, suspension, or any other unrelated component fails, PrimeCraft Autobears no responsibility whatsoever for such failure. Each service is independent and isolated in scope.

5. Customer Responsibilities

The Customer agrees to:

  • (1)Accurately disclose all known issues, prior repairs, modifications, and relevant history of the vehicle before service begins.
  • (2)Remove all personal valuables and items from the vehicle prior to drop-off. PrimeCraft Auto is not responsible for lost, stolen, or damaged personal property.
  • (3)Collect the vehicle within 48 hours of notification that service is complete. Storage fees may apply after this period.
  • (4)Pay all invoiced amounts in full prior to vehicle release. Unpaid balances may result in a lien on the vehicle.
  • (5)Inspect the vehicle at the time of pick-up and report any concerns before leaving the premises. Concerns raised after departure may not be honoured under warranty.

6. Payment Terms & Deposits

A deposit of 50% of the estimated service cost is required to confirm a booking. Deposits are non-refundable if the Customer cancels within 24 hours of the scheduled appointment or fails to appear. The remaining balance is due upon completion of service and before vehicle release. PrimeCraft Auto accepts payment by credit card, debit card, and e-transfer. Cheques are not accepted.

Estimates provided prior to service are non-binding. Final invoiced amounts may differ if additional work is required, which will be communicated to the Customer for approval before proceeding.

7. Dispute Resolution

In the event of a dispute, the Customer must first contact PrimeCraft Auto in writing at [email protected] the applicable warranty period stated in Section 3. PrimeCraft Auto will respond within 5 business days and make reasonable efforts to resolve the matter. If a resolution cannot be reached, the parties agree to submit the dispute to binding arbitration before initiating any court proceedings. The Customer waives the right to participate in any class action lawsuit against PrimeCraft Auto.

Any legal action must be filed within one (1) year of the date of service. Claims filed after this period are permanently barred.

8. Indemnification

The Customer agrees to indemnify, defend, and hold harmless PrimeCraft Auto, its owners, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) the Customer's breach of these Terms; (b) the Customer's misrepresentation of vehicle condition or history; (c) the Customer's negligent or wrongful conduct; or (d) any claim by a third party arising from the Customer's use of the vehicle following service.

9. Disclaimer of Warranties

Except as expressly stated in Section 3, all services are provided "as is" without any additional warranty, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. PrimeCraft Auto does not warrant that any service will make the vehicle free from defects or suitable for any specific use beyond the scope of work performed.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in whichPrimeCraft Auto operates, without regard to conflict of law principles. Any disputes not resolved by arbitration shall be submitted to the exclusive jurisdiction of the courts of that jurisdiction.

11. Changes to These Terms

PrimeCraft Auto reserves the right to update or modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of our services after such changes constitutes acceptance of the new Terms.
